Michelle DuCharme has extensive experience in employment litigation and counseling matters. She assists employers in multi-plaintiff class action and single plaintiff litigation matters involving wage and hour, trade secret misappropriation, sexual harassment, discrimination, retaliation, failure to accommodate, and wrongful discharge claims. Michelle regularly represents clients in both state and federal court and before administrative agencies including the Labor Commissioner, Workers’ Compensation Appeals Board, and the Equal Employment Opportunity Commission. She has been involved in all phases of litigation, including pre-litigation workplace investigations, drafting and responding to pleadings, law and motion practice, fact and expert discovery, taking and defending depositions, mediation and settlement negotiations, evidentiary hearings, trial preparation, and appeals. Michelle also counsels employers on compliance with state and federal employment laws, including drafting employment policies and handbooks, assisting with employee terminations, drafting employment and severance agreements, and evaluating employee classifications.
Michelle also has experience counseling clients in intellectual property law matters with a focus on establishing, protecting, and defending trademark rights, including on the internet. Michelle has worked with clients on trademark and domain name disputes.
Prior to joining Sacks, Ricketts & Case LLP, Michelle worked as an associate in an Am Law 50 firm where she focused her work on labor and employment matters. She also spent several years as an attorney for the United States District Court for the Eastern District of California.
