Biography

Rod Sorensen is a partner at Sacks, Ricketts & Case LLP.  Rod has over 20 years of employment-related litigation experience, including wrongful termination, discrimination, sexual harassment, unfair competition and wage and hour class actions in state and federal court proceedings, administrative hearings, mediation, and arbitration.  He also assists companies with contractual disputes with contractors, vendors, and other third parties.

In addition, Rod counsels employers on issues arising under state and federal employment laws.  Rod counsels clients regarding the protection of proprietary information, litigation avoidance, restrictive covenants, wage and hour issues, terminations, investigations, drafting compensation and severance packages, reductions in force and workplace violations, and international employment law matters.

Rod joined Sacks, Ricketts & Case LLP in August 2019.  Rod was previously the managing partner of the Silicon Valley and San Francisco offices of Payne & Fears LLP and prior to that, he was a partner at the Silicon Valley office of DLA Piper.

Representative Matters
  • Represented Silicon Valley semiconductor company in retaliation claim resulting in successful resolution without any payment to former employee.
  • Represented Silicon Valley technology company in wage and hour class action resulting in Court dismissal of all class claims.
  • Represented San Francisco technology company in harassment claim.  Success at summary judgment.
  • Represented employer in class action litigation alleging and wage and hour violations resulting in successful resolution.
  • Represented start-up company in sexual harassment claim.  Success at summary judgment.
  • Represented public company in sexual harassment claim covered by many national news outlets resulting in the successful resolution of matter.
  • Prosecuted/defended unfair competition cases involving employee raiding, disclosure of trade secrets, and breach of non-compete agreements.
  • Obtained many judgments in favor of employers before the California Labor Commissioner.
  • Successfully defended many charges filed with administrative agencies, including the California Department of Fair Employment and Housing and the federal Equal Opportunity Commission.
  • Prosecuted/defended unfair competition cases involving employee raiding, disclosure of trade secrets, and breach of non-compete agreements.
  • Prosecuted many workplace violence restraining orders.
  • Advised employers in many workplace investigations.
Reported Decisions
E*TRADE Financial Corporation v. Eaton, 305 F. Supp. 3d 1029 (D. Ariz. 2018) (obtained preliminary injunction against former employee who improperly took company proprietary information).

Life Technologies v. Superior Court, 197 Cal.App.4th 640 (2011) (obtained reversal of trial court decision requiring employer to produce company-wide information relating to employees other than plaintiff).

Tamburina v. Combined Ins. Co. of America, 147 Cal. App. 4th 323 (2007) (remanding to trial court issue of whether plaintiff’s complaint must be dismissed for failure to bring action to trial within five years).
